Website Service Terms
By purchasing any recurring service from Chroma Sites, you agree to the following terms.
Website hosting and management plans are only available for Chroma Sites website customers. Some services are only available for WordPress websites.
Recurring Billing
All services are billed automatically according to the billing frequency selected during signup. Monthly services renew monthly and annual services renew annually until canceled.
By subscribing to a recurring service, you authorize Chroma Sites to charge your payment method for all recurring fees associated with your selected services.
Payment Method
You are responsible for maintaining a valid payment method for all active services.
If a payment fails, we may contact you to update your payment information. If payment is not received within seven (7) days after notice, we may suspend some or all services until payment is received.
Accounts that remain unpaid for sixty (60) days may be terminated at our discretion.
You are responsible for any reasonable costs incurred in collecting unpaid balances, including collection fees, legal fees, and related expenses where permitted by law.
If a chargeback or payment dispute is initiated, we reserve the right to immediately suspend or terminate services until the matter is resolved.
Pricing & Renewals
Services renew at the pricing in effect at the time of renewal.
We may modify pricing, fees, or service plans from time to time by providing reasonable advance notice.
Cancellation
You may cancel recurring services at any time by providing written notice.
Cancellation becomes effective at the end of the current billing period. No partial refunds, prorated refunds, or credits will be provided for unused service time.
Renewal payments are non-refundable once processed.
Service Changes
You may add, remove, upgrade, or downgrade recurring services at any time by providing written notice.
Service changes become effective at the end of the current billing period, using the same schedule and process as cancellations. Updated pricing will apply beginning with the next billing period.
Service Modifications
We may modify, replace, discontinue, or update service features, software, vendors, infrastructure providers, third-party tools, security services, backup providers, accessibility tools, compliance platforms, or related technologies as reasonably necessary to continue providing services.
We may also modify service offerings, included features, and service plans from time to time.
Availability & Security
While we make reasonable efforts to maintain website availability, performance, backups, and security, uninterrupted service cannot be guaranteed.
Many services depend on third-party providers, including hosting companies, domain registrars, software vendors, internet service providers, cloud infrastructure providers, content delivery networks, firewall providers, and other technology partners. Chroma Sites is not responsible for outages, interruptions, delays, failures, or performance issues caused by third-party providers.
Security services, monitoring, firewalls, backups, malware scanning, disaster recovery tools, and related protective measures are intended to reduce risk but cannot eliminate all risks. Chroma Sites does not guarantee that websites will be free from security incidents, unauthorized access, malware, data loss, service interruptions, or other cybersecurity events.

Any recommendations, services, tools, policies, templates, accessibility features, privacy compliance services, cookie consent solutions, or related materials are provided for informational and operational purposes only and should not be considered legal advice.
Privacy, accessibility, cookie consent, and compliance-related services are intended to support privacy and accessibility best practices but do not guarantee compliance with any law, regulation, accessibility standard, regulatory requirement, government action, investigation, claim, or lawsuit.
Clients remain solely responsible for determining their own legal obligations and for obtaining legal advice regarding compliance requirements applicable to their business.
Client Responsibility
You remain responsible for all content, data, disclosures, privacy practices, accessibility content, business operations, and legal obligations associated with your website and business.
Limitation of Liability
To the fullest extent permitted by law, Chroma Sites' total liability arising out of or relating to recurring services shall not exceed the total fees paid by you for those services during the twelve (12) months immediately preceding the event giving rise to the claim.
Chroma Sites shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, business interruption, or loss of data.
Arbitration
Any controversy or claim arising from these terms or any recurring services provided by Chroma Sites will be settled by arbitration before a single arbitrator, administered in the state of Connecticut in accordance with the rules of the American Arbitration Association. Judgment on the arbitrator’s award may be entered in any court with appropriate jurisdiction. The arbitration decision will be final and binding on all parties.
Force Majeure
Neither party will be held liable for any failure or delay in fulfilling their obligations if that failure or delay is due to circumstances beyond their reasonable control, including but not limited to natural disasters, war, government actions, labor disputes, internet outages, infrastructure failures, acts of terrorism, civil unrest, epidemics, pandemics, or interruptions affecting third-party service providers.
Right to Update Terms
We may update these terms from time to time. Continued use of services following any update constitutes acceptance of the revised terms.
Assignment
Chroma Sites may assign or transfer its rights and obligations under these terms as part of a merger, acquisition, sale of assets, business reorganization, or similar transaction.
Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict of law principles.
Severability
If any part of these terms is determined to be unlawful, void, or unenforceable, that part will be considered separate and will not affect the validity or enforceability of the remaining provisions.
Indemnification
Each party agrees to defend, indemnify, and hold the other harmless from any claims, damages, liabilities, losses, costs, or expenses arising from its own negligence, misconduct, breach of these terms, or violation of applicable law.
Entire Agreement
These terms, together with the selected service plan descriptions, applicable service pages, and any applicable service agreements between the parties, constitute the entire agreement relating to recurring services and supersede all prior discussions, representations, proposals, or understandings relating to those services.
Plan features, limitations, included services, pricing, and other service-specific details are described on the applicable service pages maintained by Chroma Sites.

Chroma Sites may modify service features, limitations, included services, software, vendors, technologies, pricing, and plan offerings from time to time. The current service pages published by Chroma Sites shall control and supersede any prior descriptions or representations regarding those services.
